Terms of Service

By accessing or using CESIOME, you accept these Terms in full and agree that they form a binding agreement between you and the operator of the CESIOME service. You may use the service only if you are at least 16 years old and have legal capacity to contract under the law that applies to you. The 16+ requirement reflects CESIOME's operational rule for this service and the Romanian implementation of GDPR Article 8 for digital consent by minors. If you use the service on behalf of an organization, you represent that you have authority to bind that organization.

CESIOME creates personalized digital certificates for occasions such as love, weddings, and gifts. You choose an occasion, enter names and a short message, select a style, preview the certificate live, pay, and download the finished certificate as a PDF and PNG. A private link lets you return to the certificate. Available occasions, styles, formats, and delivery methods may change over time.

Every certificate is a personal, commemorative keepsake for novelty and sentimental purposes only. It has NO legal, official, governmental, evidentiary, or financial value. A certificate is not an official record, diploma, license, accreditation, identity document, government document, contract, or proof of any fact, right, status, qualification, relationship, ownership, or obligation.

The names, messages, dedications, and other details you enter are user-provided content. You retain any rights you already hold in that content, subject to third-party rights. CESIOME does not claim ownership of your content merely because it is rendered into a certificate.

By personalizing a certificate, you grant CESIOME a limited, non-exclusive, worldwide, royalty-free license to screen, process, render, temporarily store, transmit, and deliver the certificate. This license is limited to operating the service, fulfilling your purchase, providing the private return link, handling security and revocation, and responding to lawful complaints. CESIOME stores as little as possible: certificate details are held only briefly, keyed to an opaque token, and then expire. CESIOME does not track users, create profiles, or set analytics or advertising cookies. This license does not allow CESIOME to sell your content as a separate creative work.

You are solely responsible for all content you enter, including names, messages, dedications, likenesses, and personal references, and for the consequences of downloading or sharing the certificate. You represent that you have the right to use that content and that it does not violate privacy, publicity, copyright, trademark, moral, or other third-party rights. CESIOME does not verify, endorse, or guarantee the truth, accuracy, authorization, or appropriateness of anything you enter.

You must review the live preview before payment. CESIOME is not responsible for correcting user-entered spelling, names, dates, messages, or factual statements after generation. When tributes and memorials become available, any names, dates, images, or personal references you enter to commemorate another person will remain your responsibility, and you affirm that you have the right to create and share that tribute.

You may not use CESIOME for content that is illegal, hateful, harassing, threatening, abusive, defamatory, fraudulent, impersonating, exploitative, or sexually explicit involving minors. You may not infringe another person's intellectual property, privacy, publicity, or other rights, or use a certificate to falsely imply authorization, endorsement, identity, status, or affiliation.

You may not use CESIOME to facilitate fraud, sanctions evasion, money laundering, terrorist financing, unlawful commercial activity, or any other violation of applicable law. You may not bypass content screening, Reserved Entity review, payment controls, access controls, or revocation measures through altered spellings, coded references, automated requests, token guessing, or any other means.

CESIOME does not and cannot verify the truth, accuracy, legality, authorization, or evidentiary value of user-provided content. Creating a certificate does not mean that CESIOME agrees with, has investigated, or endorses anything it contains. CESIOME does not confirm that a named person exists, that a relationship or event occurred, or that any person or organization approved the content.

You bear sole responsibility for certificate content. Anyone who relies on a CESIOME certificate as factual or official proof does so at their own risk. A certificate must not be presented as evidence of identity, authority, qualification, relationship, ownership, employment, academic status, financial status, or official certification.

Automated screening, blocklist checks, Reserved Entity routing, or manual review do not make CESIOME a verifier. These controls reduce obvious abuse and platform risk. Content that passes screening may still be false, unauthorized, misleading, defamatory, or unlawful, and the user remains responsible for it.

Certificates naming certain protected or reserved entities, such as major brands, public figures, public institutions, financial institutions, celebrities, political figures, or other entities of significant public interest, may require additional review. This is a safeguard against impersonation, misuse, and false endorsement. It is not a separate certificate category or the core purpose of CESIOME.

CESIOME may ask for limited information reasonably needed to assess authority or context. CESIOME may approve or decline a Reserved Entity request at its discretion and is not required to give reasons. Approval of one request does not guarantee future approval, and a certificate may still be revoked if later information shows that its content is unauthorized, misleading, unlawful, or harmful.

CESIOME screens content and may refuse or later revoke any certificate that violates these Terms, appears illegal, hateful, harassing, defamatory, impersonating, abusive, rights-infringing, or sexually explicit involving minors, or is subject to a credible legal or safety complaint. CESIOME may act without prior notice where prompt action is reasonably needed. The verification page for a revoked certificate will show the certificate as revoked.

Revocation is a platform-integrity measure. It does not decide the legal merits of a dispute and does not necessarily mean that a user acted unlawfully. It means CESIOME has decided that the certificate may no longer remain active under these Terms or the service's safety controls. Refund eligibility is assessed separately under the Refund Policy.

The price for a certificate is shown before checkout and may vary by occasion, style, format, promotion, or territory. The price you confirm at checkout is the price for that order, subject to applicable taxes and payment-provider charges disclosed before payment. CESIOME may change prices for future orders without changing completed purchases.

Payment is handled by a third-party payment processor under its own terms and privacy policy. Payment methods depend on what the processor makes available in your territory. CESIOME never sees or stores your full card number, security code, bank credentials, or wallet keys. It may receive a limited order identifier, payment status, and other transaction details needed to confirm payment, deliver the certificate, address a refund, or meet legal obligations.

You may cancel before certificate generation begins. After generation or delivery has begun, all purchases are final except for the limited cases listed in the Refund Policy. Under EU Directive 2011/83/EU Article 16(m), implemented in Romania via Art. 16(m) of Annex 1 to Legea 363/2007, the standard 14-day withdrawal right does not apply to qualifying digital content supplied on a non-tangible medium when performance has begun with the consumer's prior express consent and acknowledgment that the right is lost.

BY COMPLETING PAYMENT, YOU REQUEST IMMEDIATE GENERATION AND DELIVERY OF YOUR PERSONALIZED CERTIFICATE AND ACKNOWLEDGE THAT THE 14-DAY WITHDRAWAL RIGHT MAY BE LOST ONCE PERFORMANCE BEGINS. A personalized PDF or PNG cannot be returned in the way a physical item can be returned. Mandatory rights that cannot lawfully be waived remain unaffected.

The CESIOME name, wordmark, certificate designs, layouts, typography, interface compositions, rendering logic, and other platform elements are protected by copyright, trademark, trade dress, and other intellectual property rights. Purchasing a certificate does not transfer ownership of CESIOME's design system, templates, software, branding, or platform materials.

You receive a non-exclusive, non-transferable, non-sublicensable, personal, revocable license to use the individual PDF and PNG delivered for your order. The license may be revoked for a breach of these Terms, including misleading commercial reuse, unauthorized copying of the design, or presenting the certificate as official proof of a fact CESIOME has not verified.

You may share your certificate on personal social media, personal websites, messaging services, and private communications, provided that doing so does not mislead others about what CESIOME is. You may also share the private certificate link with people you choose. Anyone who receives that link may be able to view the certificate, so you are responsible for how you distribute it.

You may not republish CESIOME branding or certificate designs in a misleading or unauthorized commercial context, claim that CESIOME endorses or officially certifies the content, or create competing templates from CESIOME's designs. You may not remove notices or alter an output to imply legal authority, governmental status, evidentiary weight, or third-party approval.

Neither party is liable for delays, failures, interruptions, or non-performance caused by circumstances beyond reasonable control. These may include war, civil unrest, pandemics, government or court orders, sanctions, critical infrastructure or energy failures, internet outages, cyberattacks, natural disasters, labor disruptions, or failure of essential payment, hosting, security, storage, or delivery providers.

CESIOME will use commercially reasonable efforts to restore the service after such an event, but it does not guarantee uninterrupted access, immediate regeneration, or preservation of every optional feature or certificate style during the event.

If such an event affects a paid order, CESIOME may attempt delayed delivery, regeneration, restoration of the private link, or another reasonable workaround before assessing any refund request under the Refund Policy.

CESIOME is provided on a best-effort basis. There is no service level agreement, uptime guarantee, guaranteed response time, or commitment that a particular occasion, certificate style, export format, payment method, private-link period, Reserved Entity review path, or administrative workflow will remain available indefinitely.

Maintenance may occur without advance notice. The service may be modified, suspended, rate-limited, or discontinued for security, legal, provider, product, or operational reasons. CESIOME may also refuse service where a request creates disproportionate legal, reputational, security, or abuse risk.

THE SERVICE IS PROVIDED AS IS AND AS AVAILABLE. CESIOME DISCLAIMS ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT TO THE MAXIMUM EXTENT PERMITTED BY LAW. CESIOME DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, AVAILABLE IN EVERY TERRITORY, OR COMPATIBLE WITH EVERY DEVICE, BROWSER, PAYMENT METHOD, PDF VIEWER, OR IMAGE VIEWER.

CESIOME does not guarantee that any third party will recognize, accept, believe, preserve, or respond favorably to a certificate. Its novelty and commemorative nature is central to the service. Any use as legal, official, governmental, financial, employment, academic, regulatory, contractual, or evidentiary proof is outside the intended purpose and at the user's risk.

To the maximum extent permitted by law, CESIOME's maximum aggregate liability for a claim arising from or relating to a certificate is limited to the amount paid for that certificate. CESIOME is not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including reputational harm, loss of opportunity, data, goodwill, profits, or business, third-party reactions, chargeback consequences, or social media consequences.

Mandatory non-waivable carve-outs under Romanian and EU mandatory law remain preserved. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or gross negligence under Romanian Civil Code Article 1355. Nothing excludes liability that cannot be excluded by mandatory consumer law.

You agree to indemnify, defend, and hold harmless CESIOME, the operator of the CESIOME service, its successors, service providers, and agents from third-party claims, demands, damages, losses, liabilities, costs, and expenses arising from content you enter or share, including claims involving defamation, impersonation, intellectual property, privacy, publicity, consumer protection, or unfair competition.

The indemnity also covers claims arising from your breach of these Terms, misuse of a certificate, attempt to bypass Reserved Entity review or moderation, unauthorized use of a name, likeness, or personal reference, or violation of applicable law. CESIOME may assume control of the defense for claims affecting its platform or intellectual property.

These Terms are governed by Romanian law. The courts of Bucharest, Romania, have jurisdiction over disputes arising from these Terms, subject to mandatory consumer protection rules. Where a user qualifies as a consumer domiciled in a Member State of the European Union other than Romania, Regulation (EU) 1215/2012 (Brussels I Recast), Articles 17-19, applies: the consumer may bring proceedings before the courts of their domicile and may be sued only in those courts. Nothing in this Section restricts such rights.

CESIOME does not impose mandatory pre-dispute arbitration. Any clause that would force pre-dispute arbitration against an EU consumer would be void or unenforceable under Directive 93/13/EEC where it creates an unfair imbalance. The EU Online Dispute Resolution platform is available at https://ec.europa.eu/consumers/odr.

Nothing in these Terms excludes, restricts, or waives mandatory statutory consumer rights under EU or Romanian law. Rights under OG 21/1992 (Government Ordinance 21/1992 on consumer protection), Legea 363/2007 (Law 363/2007 transposing EU Directive 2011/83/EU on consumer rights), and other mandatory consumer protection rules remain preserved in full. If a provision of these Terms conflicts with a mandatory consumer right, the mandatory right controls for the affected consumer and the rest of the Terms continues to apply.

The withdrawal-right waiver for immediate digital content delivery is intended to operate only within the limits allowed by EU Directive 2011/83/EU Article 16(m) and Art. 16(m) of Annex 1 to Legea 363/2007. It does not remove mandatory rights for defective digital content where those rights cannot lawfully be excluded.

If any provision of these Terms is held invalid, illegal, void, or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable while preserving its commercial and legal purpose as closely as possible. If modification is not possible, the provision will be severed only to the extent of invalidity.

The remaining provisions will continue in full force and effect. A finding that one clause is unenforceable does not affect the validity of the rest of these Terms, the Privacy Policy, the Cookie Policy, or the Refund Policy.

CESIOME's failure to enforce any right, remedy, restriction, or provision does not constitute a waiver of that right or provision. A delay in responding to misuse, complaints, chargebacks, impersonation, intellectual property concerns, Reserved Entity disputes, or payment issues does not prevent CESIOME from acting later.

Any waiver must be express and in writing to be effective, and a waiver in one instance does not operate as a waiver in any future or similar instance. Platform discretion remains available even if similar certificate content was previously allowed.

These Terms, together with the Privacy Policy, Cookie Policy, and Refund Policy, form the complete agreement between you and CESIOME regarding use of the service. They replace prior statements, informal messages, marketing text, interface copy, previews, or discussions to the extent those materials conflict with the legal documents.

Product descriptions explain how the service is intended to work, but they do not create legal status, official recognition, warranties, or obligations beyond the express commitments in these documents.

If localized interface text, help text, checkout provider text, or social media previews conflict with these Terms, the legal documents control to the maximum extent permitted by mandatory consumer law.

CESIOME may assign, transfer, delegate, or novate these Terms and related rights or obligations to an affiliate, successor, acquiring entity, newly formed company, purchaser of substantially all assets, or provider involved in restructuring the service, without obtaining user consent, provided mandatory consumer rights remain protected.

You may not assign or transfer your rights or obligations under these Terms without CESIOME's prior written consent. A certificate license is personal to the purchaser and does not transfer the underlying CESIOME design rights.

CESIOME has no user accounts and does not send behavioral marketing based on certificate content. Where contact information is available, you consent to necessary electronic communications such as payment or delivery notices, refund decisions, Reserved Entity review responses, moderation responses, policy updates, security notices, and administrative messages. Notices may also appear on the website or a certificate verification page.

You are responsible for accurate contact information where it is requested. CESIOME is not responsible for failed delivery caused by an incorrect address, spam filtering, mailbox limits, provider outages, or user-side blocking. Keep your private certificate link safe, because CESIOME may be unable to restore access after transient certificate details and delivery records expire.

CESIOME may update these Terms as the certificate service, payment providers, Reserved Entity safeguards, legal obligations, company structure, or risk controls evolve. Material changes will be shown by updating the Last updated date at the top of this page. Where practical and legally required, additional notice may be provided on the site or through available contact information.

Continued use of CESIOME after updated Terms are posted constitutes acceptance to the extent permitted by law. If you do not accept the updated Terms, stop using the service. Existing disputes may still be assessed under the version in effect when the relevant purchase or event occurred, unless mandatory law requires otherwise.

Include the certificate serial number, order ID, review request ID, private-link token, or relevant URL where available so CESIOME can identify the issue without collecting unnecessary additional data.
